How Long Service Leave Works in Tasmania

Long service leave is the state-law reward for staying: unlike annual or sick leave (which come from the national Fair Work system), it is governed by each state’s own Act — in this case the Long Service Leave Act 1976 (Tas). In Tasmania that means 8⅔ weeks of paid leave for the first 10 years of continuous employment, with proportionate entitlements from 7 years in qualifying cases — the proportion your service bears to 10 years.

“Continuous service” is the load-bearing phrase. Paid leave, and many kinds of approved unpaid absence, don’t break it; what counts and what merely pauses the clock is defined by the Act, and it is worth checking before assuming a career break reset you to zero. The entitlement attaches to service with one employer — though transfers of the business can preserve continuity.

A Worked Example

Someone leaving after 8 years in a qualifying case receives 8/10 of 8⅔ weeks ≈ 6.93 weeks as a payment. At the full 10 years, the entitlement is the whole 8⅔ weeks.

Leaving Before the Full Term: Pro-Rata Rules

Between 7 and 10 years the Act grants leave in the same proportion to 8⅔ weeks as your completed service bears to 10 years, in qualifying circumstances. Mining employees have a separate, older 13-week scheme under the Act.

Which law applies if I moved states?

Generally the state where you work, not where your employer is headquartered. If your service spans states with one employer, the applicable Act and how interstate service counts can get genuinely tricky — that is a question for the state regulator, with your service history in hand.

Is long service leave paid at my normal rate?

It is paid under the Long Service Leave Act 1976 (Tas)’s own pay definition — broadly your ordinary pay for ordinary hours, excluding overtime. Where pay varies, the Act prescribes how to average it. It is leave, not a bonus: you take it as paid time off, or receive the balance as a payment when employment ends (where the rules above allow).

What if my employer says I have no entitlement?
